These Terms of Use (“Terms”) govern your access to and use of www.norberthood.com and the content, features, and services made available through it (collectively, the “Site”). The Site is owned and operated by Polly Parker Press, LLC, doing business as Norberthood (“Polly Parker Press,” “Norberthood,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. Purchases completed on Spreadshirt, PollyParkerPress.com, Simon & Schuster, or another third-party site are also governed by that site’s terms, privacy policy, shipping rules, and return policy.

1. Eligibility and Use by Minors

You must be able to form a binding contract under applicable law to agree to these Terms. If you are under the age of legal majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian. Children under 13 may not submit personal information, subscribe, contact us, or send fan content through the Site; a parent or legal guardian must act on the child’s behalf.

2. Changes to the Site or These Terms

We may update the Site and these Terms from time to time. The effective date above shows when these Terms were last revised. Changes apply prospectively when posted unless applicable law requires additional notice. Your continued use after revised Terms take effect constitutes acceptance to the extent permitted by law. We may suspend, modify, or discontinue any part of the Site without liability, subject to applicable law.

3. Intellectual Property Ownership

The Site and its content—including the Norbert character and likeness, artwork, illustrations, photographs, scans, videos, audio, stories, text, designs, logos, graphics, downloads, page layouts, compilations, and other materials—are owned by or licensed to Polly Parker Press and are protected by United States and international copyright, trademark, trade-dress, unfair-competition, and other intellectual-property laws.

NORBERT® and related names, logos, slogans, characters, distinctive designs, and source identifiers are trademarks or other proprietary assets of Polly Parker Press, LLC. No license or right to use any trademark, character, likeness, artwork, or other proprietary material is granted except for the limited permission expressly stated below. All rights not expressly granted are reserved.

4. Limited Permission to Access the Site

Subject to these Terms, Polly Parker Press, LLC grants you a limited, revocable, nonexclusive, nontransferable permission to access and view the Site through an ordinary web browser solely for your personal, noncommercial use.

This permission does not authorize you to copy, download, print, reproduce, republish, save, distribute, transmit, display, perform, modify, adapt, translate, create derivative works from, sell, license, commercially exploit, or otherwise use any Site content without the prior written permission of Polly Parker Press, LLC.

No ownership interest or intellectual-property right is transferred to you. All rights not expressly granted are reserved. This limited permission automatically terminates if you violate these Terms.

Nothing in these Terms is intended to restrict any right that cannot legally be waived or limited under applicable law.

5. Prohibited Uses

Unless we give prior written permission, you may not:

·       Copy, reproduce, republish, upload, post, transmit, distribute, sell, license, display, perform, translate, adapt, modify, create derivative works from, or commercially exploit Site content.

·       Use Norbert’s name, likeness, character, artwork, photographs, voice, stories, trademarks, or other brand assets to advertise, endorse, merchandise, train or develop a product, or imply affiliation, sponsorship, or approval.

·       Use Site content or data to train, fine-tune, evaluate, ground, or develop an artificial-intelligence or machine-learning model, or to create synthetic, altered, or derivative media, except with our prior written permission or as nonwaivable law expressly permits.

·       Scrape, crawl, harvest, index, data-mine, or use automated means to access the Site or collect content or user information, except for standard search-engine indexing that follows our technical instructions.

·       Circumvent security or access controls; probe or disrupt the Site; introduce malware; overload infrastructure; or attempt unauthorized access to systems, accounts, or information.

·       Use the Site unlawfully, fraudulently, abusively, to violate another person’s rights, or to submit material that is defamatory, threatening, obscene, invasive of privacy, infringing, or otherwise harmful.

6. Fan Art, Fan Photos, Messages, and Other Submissions

We welcome kindness, but please submit only material you have the right to share. “Submissions” include fan art, photographs, messages, testimonials, stories, comments, ideas, and other materials you voluntarily send or make available to us.

You retain any ownership rights you have in your original Submission. By submitting material for possible sharing, display, or promotion, you grant Polly Parker Press a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, resize, crop, format, adapt for accessibility or presentation, publish, display, distribute, and promote the Submission in connection with Norberthood, Polly Parker Press, our charitable mission, and related websites and social channels. This license continues for content already published or incorporated into materials, but you may ask us to stop future use by contacting us; we will consider and act on the request as required by law and where reasonably practicable. A separate written release or agreement controls if one applies.

You represent that you own or have all permissions needed for the Submission; it does not infringe copyright, trademark, privacy, publicity, contractual, or other rights; it is accurate to the best of your knowledge; and, if it depicts or identifies a minor, you are the minor’s parent or legal guardian or have verifiable permission from the parent or legal guardian. Do not submit private, sensitive, or confidential information. We are not obligated to use, return, preserve, or respond to any Submission, and we may remove content at our discretion.

Unsolicited creative ideas

Please do not send unsolicited concepts for books, stories, characters, products, campaigns, or other creative projects. If you nevertheless send an unsolicited idea, you understand that we may already be developing similar material, your submission is not confidential, and no fiduciary or compensation obligation arises merely from receiving it. This paragraph does not transfer ownership of your copyright and does not limit rights that cannot lawfully be waived.

7. Third-Party Shopping and Product Links

The Norbert Shop / Spreadshirt

The Norbert Shop link directs you to a print-on-demand shop operated by Spreadshirt. Spreadshirt, not Polly Parker Press, operates that checkout and is responsible under its terms for transaction processing, production, pricing, taxes, shipping, customer service, cancellations, exchanges, and returns. Products may incorporate designs licensed by Polly Parker Press, and Polly Parker Press may receive royalties or other compensation. Questions about an order placed on Spreadshirt should be directed to Spreadshirt using the contact information provided with the order.

Book Shop / PollyParkerPress.com

The Book Shop link directs you to the separate Polly Parker Press website. Purchases completed there are governed by the terms, privacy notice, shipping policy, and return/refund provisions posted at www.PollyParkerPress.com. Those terms control the transaction if they conflict with these Site-use Terms.

Simon & Schuster and other retailers

The Photo Book page and other pages may link to Simon & Schuster, Amazon, Books-A-Million, Bookshop.org, or other independent publishers and retailers. Those parties, not Polly Parker Press, control product availability, format, pricing, payment, delivery, digital access, customer service, and returns on their sites. Some links may be affiliate links, meaning we may receive compensation if you make a purchase, at no additional cost to you.

Third-party product descriptions, prices, availability, links, and policies may change without notice. We do not warrant third-party sites or transactions. Your dealings with a third party are between you and that party, subject to rights that applicable law does not permit us to exclude.

8. Third-Party Websites, Services, and Social Media

The Site may link to or display content from third parties, including social-media and video platforms. A link or embed is provided for convenience and does not necessarily constitute endorsement. We do not control and are not responsible for third-party content, availability, security, accessibility, terms, or privacy practices. Use third-party services at your own discretion and review their policies.

9. Information and Charitable Content

Site content is provided for general informational, educational, inspirational, and entertainment purposes. References to therapy-animal work, wellbeing, kindness, charitable organizations, or products are not medical, mental-health, legal, financial, or other professional advice. No charitable statement guarantees that a particular purchase will generate a donation unless the specific offer expressly states the amount, recipient, and applicable conditions. Names and marks of charitable organizations belong to their respective owners, and references do not imply current endorsement or partnership.

10. Copyright Complaints

We respect intellectual-property rights. If you believe material on the Site infringes your copyright, send a written notice to info@pollyparkerpress.com with the subject “Copyright Notice” and include: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of your good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act; and your physical or electronic signature. We may remove or restrict material and may forward the notice to the person who supplied it. Misrepresentations in a notice may create liability. This contact information is not a representation that an agent has been designated with the U.S. Copyright Office under the Digital Millennium Copyright Act.

11. Privacy

Our Privacy Policy explains our collection, use, and disclosure of personal information and is incorporated into these Terms by reference. If you submit personal information on a third-party site, that third party’s privacy policy applies.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR SECURITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS OR THIRD-PARTY LINKS WILL BE CORRECTED. 13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLLY PARKER PRESS AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SITE, CONTENT, SUBMISSIONS, THIRD-PARTY LINKS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO POLLY PARKER PRESS FOR USE OF THIS SITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING RIGHTS AVAILABLE TO CALIFORNIA CONSUMERS.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Polly Parker Press and its owners, members, managers, officers, employees, contractors, licensors, and agents from claims, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, your material breach of these Terms, or your Submission’s infringement or violation of another person’s rights. This obligation does not apply to the extent a claim results from our own unlawful conduct, negligence where it cannot be disclaimed, or other conduct for which indemnification is prohibited by law.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Except where applicable consumer law permits or requires otherwise, any court proceeding arising from these Terms or the Site must be brought in a state or federal court located in Los Angeles County, California, and the parties consent to personal jurisdiction there. Nothing in these Terms deprives a consumer of mandatory protections of the law of the consumer’s residence.

16. Termination

We may restrict or terminate access to the Site if we reasonably believe you violated these Terms, created risk or legal exposure, or interfered with the Site or others. Provisions that by their nature should survive termination—including ownership, Submissions licenses, disclaimers, liability limitations, indemnification, and governing law—will survive.

17. General Terms

These Terms and the Privacy Policy are the entire agreement concerning use of this Site, except that separate transaction terms govern purchases on another website. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a reorganization, transfer, or sale of the business or relevant assets.
